1. Acceptance of Terms

By accessing or using the Argos Intelligence Platform (“Argos,” “the Platform”), operated by ZelenComm Digital Marketing (“ZelenComm,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, users, and others who access the Platform.

2. Description of Services

Argos is a B2B AI Visibility Intelligence Platform providing multi-dimensional digital visibility audits, keyword intelligence, search performance diagnostics, backlink analysis, technical web health assessments, and Google Business Profile optimization insights. Argos is designed for use by businesses, marketing professionals, and digital agencies.

Argos does not provide legal, financial, or medical advice. All intelligence and recommendations generated by the Platform are informational in nature and are based on data available at the time of report generation.

3. Eligibility and Account Registration

You must be at least 18 years of age to use the Platform. By using Argos, you represent and warrant that you are of legal age and have the authority to enter into these Terms on behalf of yourself or the organization you represent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify ZelenComm immediately at privacy@argosIntel.ai if you suspect any unauthorized use of your account.

4. Authorized Use

You agree to use the Platform only for lawful business purposes and in accordance with these Terms. You agree NOT to:

  • Reverse engineer, decompile, disassemble, or attempt to derive source code, methodologies, scoring algorithms, or trade secrets from the Platform
  • Reproduce, resell, sublicense, or redistribute Argos reports, scores, or intelligence outputs without prior written authorization from ZelenComm
  • Use automated bots, scrapers, or other unauthorized data collection tools against the Platform
  • Attempt to gain unauthorized access to any portion of the Platform or its infrastructure
  • Misrepresent the source or origin of Argos-generated reports or outputs to third parties
  • Use the Platform in any manner that could damage, disable, overburden, or impair ZelenComm systems
  • Submit false or misleading information in the client intake form or onboarding process

5. Intellectual Property

All content, technology, methodologies, scoring frameworks, report formats, workflow architectures, prompt systems, and underlying algorithms of the Argos Intelligence Platform are the exclusive intellectual property of ZelenComm Digital Marketing and are protected under applicable copyright, trademark, trade secret, and patent laws.

The Argos name, brand, and associated marks are trademarks of ZelenComm Digital Marketing. Nothing in these Terms grants you any right or license to use ZelenComm or Argos trademarks without express prior written consent.

You retain ownership of all data you submit to the Platform (“Client Data”). By submitting Client Data, you grant ZelenComm a limited, non-exclusive license to process and use that data solely to provide the Platform’s services to you.

6. Third-Party Integrations

The Platform may integrate with third-party services including Google Search Console, DataForSEO, and AI model providers. Your use of these integrations is also governed by the respective terms of service and privacy policies of those providers. ZelenComm is not responsible for the availability, accuracy, or conduct of any third-party services.

When you connect your Google Search Console account to Argos, you authorize ZelenComm to access read-only search performance data for the purpose of generating your visibility audit reports. This authorization is governed by Google’s OAuth 2.0 framework and may be revoked by you at any time through your Google account settings.

7. Report Accuracy and Limitations

Argos reports are generated using data from multiple sources including third-party APIs, AI language models, and publicly available information. While ZelenComm strives for accuracy, we do not warrant that reports are error-free, complete, or suitable for any specific business decision. Report data reflects conditions at the time of generation and may change.

AI-generated analysis and recommendations are based on pattern recognition and should be reviewed by qualified professionals before being used as the sole basis for significant business or marketing decisions.

8. Payment and Subscriptions

Access to Argos services requires payment as described in the applicable pricing plan at the time of purchase. All fees are stated in U.S. dollars. ZelenComm reserves the right to modify pricing with reasonable notice to existing subscribers. Refund eligibility is governed by the refund policy provided at the time of purchase.

9. Confidentiality

ZelenComm treats all Client Data and report outputs as confidential business information. We will not disclose your proprietary business data or report results to third parties except as required to provide the service, as required by law, or with your explicit consent. 10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ZELENCOMM DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZELENCOMM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ZELENCOMM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ZELENCOMM’S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless ZelenComm, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your violation of these Terms, your use of the Platform, or your Client Data.

13. Termination

ZelenComm reserves the right to suspend or terminate your account and access to the Platform at any time for violation of these Terms or for any other reason at our sole discretion, with or without prior notice. Upon termination, your right to access the Platform ceases immediately. Sections 5, 10, 11, and 12 of these Terms survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Hillsborough County, Florida.

15. Changes to These Terms

ZelenComm reserves the right to update or modify these Terms at any time. We will notify registered users of material changes by email or through the Platform. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.

He’s a past member of the Urban Land Institute, member of the University of Tampa Board of Fellows, the West Coast Chapter of CCIM Florida, past board member for Leadership Tampa Bay. He’s received numerous accolades for his work in print, website design/development, and marketing throughout his career.

As an advertising pioneer who embraces today’s technology in its early stages, Terry embodies a rare breed of individual that is creative as well as a marketing strategist. In fact, his reputation consists of crafting award winning advertising and marketing campaigns. He and his team collaborate with their clients to drive tangible results and meet the intended goals.

His firm specialized in overall marketing services, with an emphasis related to online marketing strategies and custom website and ecommerce solutions. The agency is also heavily involved in Artificial Intelligence (AI) and have embraced this extraordinary new technology.

More About Terry Zelen:

Not only does Terry enjoy involvement within his community, but also has offered his talents to pro-bono causes over the years including marketing efforts with the Tampa Bay Builders Association, Economic Club of Tampa, University of Tampa’s Entrepreneurship Center, Sustany Foundation and numerous other non-profit organizations. He’s a strong advocate for giving back to the community where he lives and works.

In his free time, he enjoys spending time with his family, fishing, diving, spear-fishing, hiking, sporting clay shooting, boating, kayaking and listening to music and he has three dogs. He also enjoys working with his hands and spends time designing and building furniture and projects at his home. He and his family are foodies and travel on their stomachs whenever they venture out on vacations. Terry additionally enjoys wines and spent his early years out of college as a waiter at Bern’s Steakhouse. He did this while starting out in the advertising business.

Terry attended the University of Tampa and obtained majors in both Marine Science, Biology and minors in Chemistry and Art. So, naturally he pursued an occupation in Marketing… He and his family live in South Tampa and enjoy the Florida lifestyle year-round.
